Most Developers in the Middle East are still using Forms of Contract modeled on old FIDIC – 3rd Edition whilst those in the UAE progressed to its 4th Edition (1987) soon after its publication. Despite the passage of two decades, the industry in this part of the world is still reluctant to adopt the new FIDIC – First Edition (1999), and those who were bold enough to test it experienced an increase in the tender prices, not only because of its introduction of onerous administrative procedures for Contractors, but also because of a trend by Developers to delete/amend provisions which would otherwise have resulted in more competitive tender prices.
Would its Second Edition (FIDIC 2017) encourage the industry stakeholders to take a different view on what they had been practicing to date?
At this CPD we would be discussing some of the provisions of FIDIC 2017 which are likely to affect the tender prices.
- Identifying some of the key concerns in FIDIC 1999 – First Edition which had adverse effects on tender prices.
- Understand how FIDIC 2017 – Second Edition attempts to counter such adverse effects.
- Learn some of the essential amendments to both Editions in order to procure competitive tender prices.
- Learn the adverse effects of the typical deletions by Developers, of standard provisions.

About the Speaker
In March this year, Prof. Sam completed his 36th year as a Fellow of the Institution. He has been in the region for 44 years and has been a mentor to hundreds of young members. His career in Quantity Surveying, Contract Administration and Dispute Resolution spans over 53 years with Developers, Consultants and Contractors in Sri Lanka and Middle East. Over five thousand practitioners have passed through his trilogy of short intensive course training programmes “Sound Contract Administration”.
Prof. Sam is a regular speaker at CPD events sharing his knowledge and experience with the industry professionals. Many construction and related industry stakeholders consult him for specialist advice when faced with complex issues in Contract Formation, Contract Administration and Dispute Resolution.
